On October 24, 1967, Edgar M. Cross was charged with forceful rape (sec. 944.01 (1), Stats.), statutory rape (sec. 944.10 (2)), and sexual perversion (sec. 944.17 (1)). Counsel was appointed for him and after a preliminary hearing, at which one of the alleged minor victims testified and was cross-examined, Cross was bound over to the circuit court for trial. On November 27, 1967, when Cross was to be arraigned, his attorney stated to the court he thought Cross ought not to be arraigned but rather should be sent to the Central State Hospital for observation to determine whether he was able to stand trial and to assist in his defense. Such a commitment was made.
